My iPhone 3gs won't restore!! 'the device isn't eligible for the rebuild"

my boyfriends iphone won't restore , keeps saying isn't eligible rebuild. isn't jailbroken, best of knowledge , disabled because went hospital , literally, 1 day woke , couldn't phone. tried password , few others million times until disabled. trying restore , keeps coming message. phone of absolutely no use me @ point. help!!!
