Is my new HD defective?

symptoms:

1. when tried partition it, got this:

2. disk utility seems think it's 3.6 tb when know it's 500 gb.

but:

1. the above occurred when using disk utility running off of tiger install dvd.
2. when used snow leopard install dvd, fine. disk utility got size of drive correct, formatted it, , i'm running snow leopard without issue.
