it's nice meet here , since i'm working hydropower construction company , our company has undertaken 400 mil usd project in laos, time duration of 6 years build diversion tunnel, head race tunnel, generation pit, spiral case, concrete face rock fill dam, powerhouse, switch yard, head-pot yard, , control building etc.. we're negotiating project employer 2 year! during time both parties encountered issues either technical, contractual or financial, i'd pose these issues here , hear opinions, thanks!
1. international standard contract construction fidic, in condition of contract, employer's put way many other rules , contiguously varied content after biding opening, entitled claim costs?
2. normal defects liability period runs 1 year while in contract, it's 2 years , covers not civil works, steel structure , hydrolic-mechanic equipment, , employer rejected our request increase costs, fair?
3. employer claims project project-financed project, means needs unconditional assignable , on-demond bank securities performance , advance payment, in amount of 40 million usd! , once project gone trouble, employer can assign , transfer contract 1 of financial parties , they'll evaluate statues of project @ time allow them see if they'll further continue project or not. standard?
