Issue with Authorized Service Provider

hi there,

seem in bit of predicament apple authorized service provider... dropped mbp off last week - having issues waking sleep, giving constant beach balls, , acting slow after reformats , starting fresh. has ended him wanting charge me $45 diagnostic fee because apparently can't find wrong, though there wrong.

machine brought in 10.6 installed on it, same operating system came factory.

news, sort of, able recreate issue computer. though tests showed unit being without defect, not boot , i'm unable boot *in call single user mode. gets kernel panic. have work sorry took long point "procedures" requires me testing first known-good system external drive .

yes did, i've installed lion 10.7 on , works out issue. no freeze or spinning beach ball. can't unit boot 10.6 on internal drive run external drive (this 1 can't it). i've reinstalled 10.6 *twice on same issue. 10.7 no problem. not find hardware issue unit.

don't see else can do. suggest if can come , pick unit (with 10.7 on it) have charge diagnostic fee of 45$ since no covered repair done on unit. if have other issue once install other applications on , need check again not charge diagnostic fee if have problem within next 2 months.

understand concerns , question legitimate.*but have refer *apple limited warranty statement (the first year of coverage not cover software issue) here excerpt of warranty documents came computer (attached whole document alw)

apple, may provide own warranties apple, in far permitted law, provides

"i understand predicament, , know important reimburses time (either apple or i), however, if known operating system install on known external hard drive, not install on existing (possibly defective) internal hard drive, when other variables identical, process of elimination, doesn't point hard drive being @ fault?

existing other hardware + different harddrive + 10.6 = successful install
existing other hardware + existing harddrive + 10.6 = unsuccessful install

thats far... sorry wall of text. i'm looking opinion, wrong saying looking warranty covered harddrive issue, or software issue cost me?

course of action take if refuses budge? apple have authority in these issues? wish had apple store nearby...

 

apple's warranty has cover operating system , hardware sold , using 'factory' os should fixing free. sound dodgy hard drive , lion somehow masking problem (no idea why). should talk apple instead of the asp , see before going further .
